Food ingredients vs food additives — the EU legal distinction

In EU food law, a food ingredient is any substance used in the manufacture of food that remains in the finished product. A food additive (EU Reg. 1333/2008) is a specific subset โ€” intentionally added substances that perform a technical function. Many FDCM products sit in both categories simultaneously.

Take xanthan gum: it is a food ingredient (it remains in the product), a food additive (E415, thickener, regulated by Reg. 1333/2008), and increasingly a clean label ingredient (it occurs naturally in fermented foods, the name is familiar to consumers even if the E-number is not).

The clean label shift: EU consumer research consistently shows that 65โ€“70% of consumers prefer products without E-numbers on the label. This is driving reformulation from E415 to xanthan gum, from E322 to sunflower lecithin, from E968 to erythritol. The ingredient is identical โ€” only the label declaration changes. Clean label food ingredients — what qualifies and what doesn't

The term “clean label” has no legal definition in EU law. In practice, it refers to ingredients that consumers can recognise, understand and consider natural. The key criteria used by major retailers and brand owners:

  • Name recognition: “Sunflower lecithin” is recognised; “E322” is not.
  • Processing method: Physical or enzymatic processing is accepted; solvent extraction or chemical synthesis often is not.
  • Origin: Plant, animal or microbial origin โ€” not petrochemical.
  • Non-GMO: Increasingly important, particularly in Germany, Austria and Benelux.
Key formulation shift: Replacing soy lecithin (E322, GMO, solvent-extracted) with sunflower lecithin (E322, non-GMO, mechanical/solvent-free available) โ€” same E-number, dramatically different clean label positioning. FDCM stocks both; sunflower commands a ~12% price premium.

The clean label hydrocolloid challenge

Xanthan gum (E415) is accepted in clean label products because it is naturally produced by fermentation, well-understood, and has no health concerns. Guar gum (E412) is a milled seed โ€” inherently natural. Both score better than synthetic thickeners or modified starches. Inulin (from chicory root) carries a strong clean label story: natural source, prebiotic benefit, familiar name. These three are the foundation of most clean label hydrocolloid systems.

Clean label means the ingredient is recognisable to consumers as natural or minimally processed โ€” no E-numbers, no synthetic processing aids. Clean label FDCM ingredients include: psyllium husk, apple fiber, native starches, sunflower lecithin (non-GMO), cocoa mass and butter, chia seeds, matcha, all nut kernels, WPC 80, WPI 90, fish and bovine collagen. Non-clean label: soy protein isolate (uses alkali processing), soy lecithin (often solvent-extracted), sucralose (synthetic). We mark both clearly so you can formulate accordingly.
Xanthan gum (E415) is microbially produced, provides pseudoplastic (shear-thinning) viscosity, is stable from pH 2โ€“12 and up to 130ยฐC, and is effective at very low concentrations (0.05โ€“0.1%). Guar gum (E412) is milled seed endosperm, provides higher viscosity per gram at lower cost but loses stability at extreme pH and temperature. In practice: use xanthan for products requiring heat or acid stability (dressings, beverages, sauces); use guar for cost-sensitive applications with standard processing (ice cream, bakery, dairy).

WPC 80 (Whey Protein Concentrate) contains approximately 80% protein, 4-8% fat and 4-8% lactose. WPI 90 (Whey Protein Isolate) contains approximately 90%+ protein, less than 1% fat and less than 1% lactose โ€” produced by additional filtration (ion exchange or microfiltration) after concentration. WPI is preferred for: lactose-intolerant consumers, clear protein beverages (WPC creates haze), very high protein density formulations. WPC 80 is preferred for: lower cost, better flavour in baked goods, applications where fat contributes to texture (creaminess).
